Job Purpose
The file handler will handle delegated and non-delegated litigated instructions on behalf of key insurer clients. The work will cover, both liability, indemnity, and quantum disputes.
The successful file handler will communicate effectively with our clients, both written and verbal, setting a strategy for bringing a claim to its resolution. A clear view on both relevant case law and appropriate evidence will be necessary.
The file handler will recognise cases with a technical bias, e.g., whether the Insurer is a contractual Insurer, RTA Insurer, or Article 75 Insurer, and what actions are required if the policyholder is a Claimant and there is a counterclaim be pursued.
Key Accountabilities
* The file handler will be responsible for the day-to-day handling of a motor litigated caseload
* Assessing the liability prospects of the case, valuation of quantum, setting strategy and advising clients – noting and abiding by Client Guidelines
* Excellent knowledge and experience of litigation, the CPR Rules and Court procedures from Defence to Trial.
* Drafting, including Court documents and witness statements and instructions to Counsel.
* Formulating initial and ongoing Strategy, efficiently and effectively, having in mind the appropriate fee structure.
* Draft reports confirming Strategy and agreeing the most suitable approach with the client.
* Throughout the lifetime of a case, being aware of the overall spend on a claim, whether fixed fee or hourly rate.
* Undertaking negotiations with Third Party Solicitors to deliver within client key performance indicators.
* Liaising with Insured and Insurers and Brokers where necessary.
* Ensuring 'actions’ are carried out as per Action Lists/Schedule in Case Management System – managing pro-active diary system.
* Undertaking Court Hearings.
* Ensuring relevant tasks are delegated to the paralegals.
* Accurately recording time.
* Accurately processing bills in accordance with Client Guidelines.
* To ensure compliance with the SRA Code of Conduct 2019
